TriMet Layoffs and Bumpbacks: Statement and MOA

ATU 757 and TriMet have engaged in expedited bargaining over the District's upcoming reduction in force, including layoffs and bumpbacks, and have reached mutual agreement on the effects of these District changes on members of the Union bargaining units. To memorialize our mutual agreement, the Union and the District have executed a Memorandum of Agreement (MOA) that governs the bumpback and layoff process the District is about to initiate. The parties have negotiated rules for seniority, position eligibility, recall rights, and other effects of the bumpback and layoff process.
The MOA expands protections for members in certain circumstances, including crossdivision bumpback rights for employees who have held positions in multiple divisions, seniority protections for employees who have previous experience as Mini-Run Operators, and a right of first refusal for involuntarily curtailed employees if their position is posted within twelve months of curtailment.
TriMet will start notifying some work groups about layoffs and bumpback starting the week of June 22nd. The District expects to make no more than 120 bumpbacks and layoffs total, with no more than 57 layoffs. The process is slated to conclude no later than September 26.
TriMet will provide affected employees with written notice of their bumpback position no less than thirty (30) days prior to the placement date. The employee is responsible for initiating and completing all required certifications, licensure, and medical clearances promptly upon receipt of notice and before the placement date.
ATU Executive Board Officers and TriMet managers will refer to the MOA in making determinations about seniority and position eligibility. The agreed-upon seniority rules in the MOA apply to multiple union employees in Union positions and non-union positions who will bumpback to union positions. In determining position availability, Board officers and managers will refer to the MOA.
If an employee is laid off due to this reduction in force, and TriMet later recalls the laid-off employee to work, the employee must respond within fourteen (14) calendar days of first contact, and must meet all applicable certification and qualification requirements before the return date. If the employee doesn’t meet all requirements they forgo their right to the recall provision.
The Union and the District recognize that circumstances may arise which cannot be planned for in advance. The parties are committed to consistent communication throughout the process.
