Following a full evidentiary hearing and consideration of the testimony, evidence, and arguments presented by both parties, the arbitrator upheld Grievances #1341 and #1479 and ordered the employee reinstated to his Operator position as quickly as reasonably possible.
The arbitration award requires the employer to make the employee whole through restoration of back pay, benefits, and seniority from the date of termination through reinstatement, including compensation for the period of unpaid suspension. Any interim earnings and unemployment compensation will be offset consistent with the award’s terms. In addition, the arbitrator directed that the records of suspension and discharge be removed from the employee’s personnel file.
While the disciplinary records related to the 2021 driving incidents will remain, the decision represents a significant ruling in favor of the Grievant and reinforces the importance of fair process and just cause protections in the workplace.
