New TriMet Court Appearance Payroll Process
|
|
TriMet has rolled out a new form for how time will be tracked when an employee is required to appear in Court. Key things to know:
Proceedings at the request of or regarding TriMet
1. If the event giving rise to the Legal Proceeding occurred while the employee was working or traveling to/from work (via TriMet) or if the appearance at the Legal Proceeding is at the request of TriMet, then TriMet will pay the employee for time spent at the Legal Proceeding (run pay for operators; regular hourly rate others). The employee must return to work if practicable at the conclusion of the Legal Proceeding.
Private Litigation
2. If the event giving rise to the Legal Proceeding occurred while off duty and/or relates to the personal rights or obligations of the employee and not TriMet, TriMet will not pay the employee. The employee must use their leave bank hours or it will be treated as an excused absence without pay if no leave hours are available.
The form is attached below.
